Terms of service

These terms govern use of Qasid, a conversation CRM operated by Cubex Technologies SMC-Pvt Ltd, registered in Pakistan ("we", "us"). By using Qasid you agree to them.

The service

Qasid receives messages sent to your business on WhatsApp, Instagram and Facebook, routes them to your staff, and lets your staff reply. It connects to those platforms through Meta's official APIs using accounts you own and authorise.

Your account

• You must be a business, and the person agreeing to these terms must be authorised to bind it
• You are responsible for your staff accounts and for what is done through them
• Keep sign-in credentials confidential and tell us promptly if an account is compromised
• You are responsible for the accuracy of the information you give us

Acceptable use

You agree not to use Qasid to:

• Send unsolicited messages, or message anyone who has not consented to hear from you
• Breach Meta's WhatsApp Business Messaging Policy or its platform terms
• Send unlawful, deceptive, abusive or infringing content
• Impersonate another business or person
• Attempt to access another customer's data, or to probe or disrupt the service
• Resell or sublicense access without our written agreement

Meta enforces its own rules independently of us. It can restrict or disable your messaging account for reasons outside our control, and we are not responsible when it does.

Your data

• Your conversations, contacts and content remain yours
• We handle them only to provide the service, as described in the privacy policy
• You can export your data at any time while your account is active
• You are responsible for having a lawful basis to message the people you message

Messaging charges

Meta charges for messages separately from anything you pay us. Those charges are billed by Meta directly against your own WhatsApp Business Account. We do not collect them, do not mark them up, and have no control over Meta's rates, which Meta can change.

Fees

• Fees, billing frequency and any setup charge are set out in your order or quotation
• Fees are exclusive of taxes unless stated otherwise
• Invoices are payable within the period stated on them
• We may suspend access to accounts that remain unpaid after written notice

Availability and support

We aim to keep Qasid available and will give notice of planned maintenance where we reasonably can. The service depends on Meta's platforms and on third party infrastructure, and we do not guarantee uninterrupted availability unless a separate service level agreement says so in writing.

Suspension and termination

• You may stop using Qasid at any time, with notice as set out in your order
• We may suspend or terminate an account that breaches these terms, that puts the service or other customers at risk, or that remains unpaid
• On termination we give you a reasonable period to export your data, then delete it in line with the retention periods in the privacy policy

Intellectual property

Qasid, its software, design and brand belong to Cubex Technologies SMC-Pvt Ltd. Access to the service does not transfer ownership of any part of it. Feedback you give us may be used to improve the product without obligation to you.

Disclaimer and liability

Qasid is provided on an "as is" basis. To the fullest extent permitted by law we exclude implied warranties of merchantability and fitness for a particular purpose.

We are not liable for indirect or consequential loss, including lost profits, lost business or lost data arising from use of the service. Our total liability in any 12 month period is limited to the fees you paid us in that period.

Nothing here excludes liability that cannot lawfully be excluded.

Changes

We may update these terms. Where a change materially affects your rights we will give at least 30 days notice by email. Continuing to use Qasid after a change takes effect means you accept it.

Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan. The courts of Karachi have exclusive jurisdiction over any dispute.
